Ongoing Monitoring of ELD Transposition and Archive of Member State Legislation
The Group has been monitoring the ELD transposition activities of each Member State of the European Union since 2004, thus our information comprises a comprehensive repository of EU-wide ELD transposition status and progress. Materials available via the Group include copies of draft and final laws and related documents as available (consultation documents, explanatory memoranda, impact assessments, regulations). To date, all 27 Member States have implemented the ELD into national law. The Group has compiled electronic copies of nearly all final Member State legislation, as well as a number of English versions of this legislation.
Related EU Directives
There are a number of Directives, currently in force and proposed, which are relevant to the Environmental Liability Directive. These Directives include the Seveso II Directive, Water Framework Directive, IPPC Directive, Habitats Directive, Birds Directive – all of which are in force – and the proposed Soils Directive and Environmental Crimes Directive. The Group is working to assess the actual and potential interface between the various Directives and related issues.
Industry Positions on the EU ELD
The Group’s White Paper, “EU Environmental Liability Directive: Practical Suggestions to Ensure Sound Implementation”, highlights key considerations concerning implementation of the EU Environmental Liability Directive by individual Member States and suggests ways that the industrial community can work to facilitate regimes that reflect sound policy, law and methodology. Other documents on ELD-related methodological issues prepared by the Group have been provided to the European Commission, DG Environment staff and the Group continues to interact with Commission staff in the interest of forging a reasonable, balanced and predictable pan-European ELD practice.
Documents prepared by the Group are intended for broad industrial community use and can be made available to any company (member or non-member of the Group) and business/industry association upon request. |
